Hazard Hosts states that all services must be used for lawful purposes only and that illegal or harmful activity may be monitored, reported, suspended, or terminated.
Terms of Service
These terms define the relationship between Hazard Hosts and its users, including lawful usage, acceptable use, security obligations, payment terms, refunds, disputes, and billing rules for services provided through HazardHosts.com.
The terms prohibit hacking, spam, phishing, copyrighted files without authorization, prohibited adult content, botnets, IP scanning, TOR relays, and other abusive or illegal activity.
The terms explain activation after payment, non-refundable product categories, dispute consequences, accidental payment handling, and non-payment suspension or termination rules.
Overview and acceptance
The current terms say they govern and define the relationship between the client, guest, and Hazard Hosts across the website and all other services provided by Hazard Hosts. By using the services, the user automatically agrees to the terms and conditions and is expected to understand them.
The terms also say they apply to all services and should be read together with the privacy policy while using Hazard Hosts services. They emphasize security, safety, and accountability as core values, and require usage of services to be lawful and in line with the listed terms and conditions.
General lawful principles
The terms state that all services must be used for lawful purposes only. Hazard Hosts says it is not legally obligated to monitor client activities, but may monitor and respond to complaints involving offensive, violent, undesirable, or illegal activities, and that any illegal findings will be reported to the appropriate judicial authorities.
Examples of unacceptable activity listed in the terms include the use or sale of pirated content, copyright infringement, illegal release of sensitive information, fraud, underage exposure, malicious content, and sale of unauthorized goods or regulated illegal items and services.
Fair use policy
The current terms say services are not explicitly limited by bandwidth or disk space, but restrictions may still apply under the fair use policy. If a service uses an excessive amount of bandwidth, RAM, or CPU, Hazard Hosts says it may send warnings by email, and if the issue is not fixed in time, the service may be suspended or limited.
For VPS and dedicated servers, the terms say users must not host illegal or nulled websites, conduct email spam, or host or interact with nulled or illegal software. The terms also prohibit DoS or DDoS tools, port scanning, spam scripts, and hosting game panels, virtualization, or other hosting-related services without prior written approval. The terms further note that service descriptions such as CPU, RAM, and internet speed are intended to be accurate, but inadvertent inaccuracies may occur.
The terms also say domains found in violation may be suspended without notice until violating content is removed, and that domain purchase fees are non-refundable.
Indemnification and refusal of service
The terms say the customer agrees to hold Hazard Hosts free from liability, loss, expenses, and claims, including losses connected to the negligence of the customer or indirect causes connected to Hazard Hosts. They also say Hazard Hosts and its associated employees, directors, suppliers, and related parties are not to be held liable unless required by governing law and proven as a direct cause in court.
Hazard Hosts says it reserves the right, at its discretion, to refuse, terminate, or cancel any service in the event of unlawful activity, violation of the terms, violation of the privacy policy, indecent conduct, EULA violations, or violation of a game’s monetization rules and guidelines. The terms say policy violations may result in immediate termination and are not entitled to refunds of any kind.
Acceptable use policy
The terms say Hazard Hosts will not provide services to users engaged in hacking, unauthorized access attempts, port scans, stealth scans, phishing, hosting copyrighted files without authorization, spamming, or uploading content that violates rights of publicity or privacy.
The terms also prohibit hate speech, obscene or abusive content, libelous or defamatory content, child pornography, bestiality, scam sites, phishing sites, illegal material, pornographic material, lewd or obscene materials, satanic materials, massive CDN streaming on its infrastructure, threatening to DDoS, DDoSing, doxing, stealing files, spoofing IP addresses, botnets, IP or port scanning, GRE tunnels, OpenVPN, open proxies, TOR relays, TOR exit nodes, and attempts to bypass service limits.
Security requirements
The terms state that users must not share account details with any individual or organization. They also say the account holder is responsible for actions taken through the account, and that violations caused through the account may result in penalties.
The terms add that if an account is breached and the breach is not reported to Hazard Hosts, the company may suspend or terminate the service and prevent future ordering. The terms also say users must not exploit flaws in Hazard Hosts software or hardware, or in the software or hardware of other internet services, and that any discovered flaws or potential exploits must be reported through a billing panel ticket.
Payments, refunds, and disputes
The current terms say services will not be activated until the first payment is successfully received. If a service is not renewed before the stated expiration date, the terms say it will be suspended automatically until payment is made, after which the service may be terminated and associated files removed from the servers.
The terms state that dedicated servers, VPS servers, software licenses, and managed or semi-managed support services are not eligible for refunds after activation or provision. In some special situations, Hazard Hosts says it may issue account credit at its sole discretion. Setup fees, add-ons, custom features, bundled unused months, and cryptocurrency purchases are stated to be non-refundable.
The terms further say chargebacks or payment disputes on any payment processor or platform will result in immediate account suspension and may lead to termination of all services without notice. If a dispute is opened without first contacting support, the terms say the user is not eligible for a refund. The terms also say a $35 fee may be added to the invoice and collections efforts may follow, with the customer responsible for related fees.
For overpayments or accidental payments, the terms state that Hazard Hosts will work constructively with the client to rectify the issue, provided the client clearly identifies the payment method and date of the payment in the refund request.
Billing, invoicing, and price changes
The current terms say the due date is 30 days after purchasing a server. They state that billing disputes do not exempt the user from paying current and future invoices, and that disputes resolved in the user’s favor will receive account credit.
The terms also say bandwidth overage may be billed at a default rate of $0.15 per GB used, with any available credits applied first. If billed amounts are not paid, the account may be sent to collections. For non-payment, the terms say VPS services may be suspended, disconnected, and terminated if invoices are unpaid by the due date at 12:00 A.M. EST, and users may lose all data if automatic termination occurs.
